Terms of Service

1. About these terms

These Terms of Service ("Terms") govern your use of the Tova application and website (collectively, "the Service"), operated by M28 Ventures BV, Belgium ("we", "us", "Tova"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Tova is a meal planning, shopping list, pantry management and optional health-logging application for families. The Service is provided via web browser and mobile web. Features vary by subscription plan (Free, Family, Pro).

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you for any modification, suspension, or discontinuation.

3. Eligibility

You must be at least 16 years old to use Tova. By using the Service you represent that you meet this requirement. If you are using Tova on behalf of a household, you represent that you have authority to bind the household to these Terms.

4. Account and security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@tovameals.com if you suspect unauthorised access. We are not liable for losses caused by unauthorised use of your account where you have failed to keep credentials secure.

5. Subscriptions and billing

Free plan: Available without payment. Access is limited to features described on the Pricing page.

Paid plans (Family, Pro): Billed monthly or annually. Prices are shown in EUR on the Pricing page. A 14-day free trial is available on new paid subscriptions — no credit card required for the trial period.

Cancellation: You may cancel at any time via Settings > Manage subscription. Paid access continues until the end of the current billing period. We do not offer pro-rata refunds for partial billing periods, except where required by applicable law.

Price changes: We will notify you at least 30 days before any price increase. Continuing to use the Service after notice constitutes acceptance of the new price.

Payment processing: Payments are processed by Stripe. We do not store card details. By subscribing you also agree to Stripe's terms.

Refunds: EU/UK consumers have a right to withdraw from a digital service contract within 14 days of purchase. If you request withdrawal within 14 days and have not used the paid features, we will issue a full refund. Contact hello@tovameals.com with subject "Refund Request".

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Scrape, crawl, or otherwise extract data from the Service by automated means without our prior written consent.
• Transmit viruses, malware, or any other malicious code.
• Impersonate another person or entity.
• Use the Service in a way that could damage, disable, overburden, or impair it.

7. Your content

You retain ownership of data you input into Tova (meal plans, notes, health logs). By using the Service you grant us a limited licence to store, process and display that data solely to provide the Service to you. We do not use your personal content to train AI models.

8. Intellectual property

The Tova name, logo, design, software, and generated content (recipe suggestions, AI outputs) are owned by or licensed to M28 Ventures BV. You may use the Service for personal, non-commercial household purposes. You may not copy, distribute, or create derivative works from the Service without our express written permission.

9. Health disclaimer

Tova provides general meal planning and nutritional information for informational purposes only. It is not medical or dietary advice. Always consult a qualified healthcare provider before making significant changes to your diet or exercise regime, particularly if you have a medical condition, allergy, or are pregnant. We are not liable for any health outcomes resulting from use of the Service.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, M28 Ventures BV's aggregate liability to you for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless M28 Ventures BV and its directors, employees and agents from any claims, losses, damages, and costs (including legal fees) arising from your violation of these Terms or misuse of the Service.

12. Governing law and disputes

These Terms are governed by the laws of Belgium. Any dispute arising under these Terms that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Belgium.

EU consumers: you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to these Terms

We may update these Terms from time to time. We will notify you by email and in-app at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance. If you do not agree to the new Terms, you may cancel your account before they take effect.
